North Macedonia: Strengthened capacities of judiciary on International Cooperation, Mutual Legal Assistance & Extradition in AML/CFT

19-22 March, Ohrid, North Macedonia - UNODC’s Global Programme against Money Laundering (GPML) has been actively engaged in the Balkans, particularly in North Macedonia, to enhance the country's capacity in Anti-Money Laundering/Countering the Financing of Terrorism (AML/CFT). GPML is delivering workshops under its court preparation project, focusing on building practitioners’ knowledge and skills in AML/CFT law, case file preparation, legal applications in court, mock trials, and international cooperation. In Ohrid GPML delivered a 4-day training course on International Cooperation, Mutual Legal Assistance & Extradition in AML/CFT for representatives from the Ministry of Foreign Affairs, Ministry of Justice, Judiciary, and Prosecutor’s Office.

The objective of the workshop was to increase practitioners' understanding of using Mutual Legal Assistance (MLA), extradition, and international cooperation aimed to equip participants with the knowledge and skills necessary to draft complete and effective outgoing requests for international assistance. A bespoke course was designed based on participant feedback, focusing on practical examples and cases to illustrate theory application.

The workshop covered modules such as confiscation, digital investigations, asset recovery, MLA and extradition requests, and international legal principles. Practical exercises, case studies, and discussions were conducted to reinforce learning and encourage participant engagement. Participants engaged in calculating benefits in real-life cases and explored hacking possibilities for accessing encrypted devices. Sessions included an asset recovery case presentation and discussions on formal and informal assistance and learned about the UN Convention against Transnational Organized Crime (UNTOC) as a legal basis for international cooperation.

Discussions revolved around the indictment process, legal bases for MLA and extradition, and key considerations for drafting requests. The sessions highlighted the importance of clear and concise drafting and adherence to domestic legislative requirements. The final session focused on reviewing outgoing requests and providing feedback. Participants identified issues in requests and proposed improvements, demonstrating effective learning applications.

The workshop facilitated by GPML has contributed to enhancing North Macedonia's capacity in AML/CFT through practical learning and engagement. Continued efforts and follow-up actions are essential to institutionalize the acquired knowledge and skills within relevant organizations.
