In April 2012, the Hungarian Government introduced a ban on new psychoactive substances that allows the Government to introduce a rapid control on these substances. The new Government Decree No. 66/2012 (in force since 03.04.2012) on activities related to narcotic drugs, psychotropic substances and new psychoactive substances, on scheduling of these substances and on modification of schedules (repealing Government Decree 142/2004 and Government Decision 1196/2009) created a Schedule (Schedule C of Annex 1 of Government Regulation 66/2012) for new psychoactive substances that lists both individual substances and compound groups (applying the generic approach) for purposes of control. It specifies the processes and appoints the responsible bodies for reporting new substances, rapid assessment, scheduling and risk assessment. According to the Decree, new psychoactive substances are notified following Council Decision 2005/387/JHA on a new psychoactive substance or based on notifications from national bodies on a new psychoactive substance. The notification is followed by a rapid assessment that may result in the schedule of the "new psychoactive substance". If so, the substance needs to be risk assessed within three years and a decision is then taken for its final inclusion in the list of "psychotropic substances" (schedules of Act XXV of 1998).
