The Consolidated Act no. 748 of 1 July 2008 on Euphoriant Substances (para. 1, 2) regulates the standard procedure to control new substances. Accordingly, their individual chemical definition is included in the list appended to the Executive Order on Euphoriant Substances. The Minister for Health and Prevention is thus empowered to lay down regulations to the effect that substances be controlled if they are regarded as (highly) dangerous by reason of their properties – under international decisions or in the opinion of the National Board of Health-. Since 2008, several new psychoactive substances have been included in List B of narcotics contained in the Consolidated Act No. 748 of 1st July 2008. These include mephedrone (added by Decree N 1329/2008 [BEK nr 1329 af 18/12/2008]), bk-MBDB, Kratom (mitragyna speciosa), MDPV, p-FBT, PPP (added by Decree No 174 of 2009 [BEK nr 174 af 10/03/2009]), TMA-6 (added by Decree No 758 of 2009 [BEK nr 758 af 16/07/2009]; 2-AI, AMT, CP 47, 497-C6; CP 47, 497-C7; CP 47, 497-C8; CP 47, 497-C9; DPT; HU-210; JWH-018; JWH-073; JWH-200; JWH-250; JWH-398; MDPPP (added by Decree 190 of 2010 [BEK nr 190 af 26/02/2010]; AM-694, AM-2201, several CP-compounds, CRA-13, HU-308, several JWH- compounds, 3,4,5-trimethoxy-phenethylamin, 4-MA, RCS-4, WIN 55,212-2 (added by Decree 187 of 2011 [BEK nr 187 af 08/03/2011]. In 2016, a number of benzodiazepines such as Clonazolam, Deschloroetizolam, Diclazepam, Flubromazepam, Flubromazolam, Metizolam, Nifoxipam and Pyrazolam, have also been added to List E of the Act on Euphoriant Substances.
